- Foden was an advisor to the Welsh Government, during the trial Child E described how he would secretly take her to hotels around the country, where he would have meetings. Some of those hotel stays coincided with Foden speaking at the Senedd.
- Multiple concerns were passed to Cyngor Gwynedd, but it was decided there would be no formal investigation as no specific allegations had been made.
- Foden was reprimanded by the teaching regulator and kicked out of his union in 2020. Yet, a year later, in 2021, he was given more responsibility as a "strategic super-head" overseeing two different schools in North Wales.
- Foden was still employed by Gwynedd Council when his trial started on April 22.

“The fact that Foden served as an advisor to the Welsh Government raises serious questions about the thoroughness of the Welsh Labour Government’s vetting process. Were they aware of any of the accusations surrounding Foden before becoming an advisor?
“Cyngor Gwynedd and the Welsh Government have a duty to fully investigate, with immediate action and transparency required to ensure such horrific abuses never happen again."
